How child custody decisions are made

Child custody is usually high on the list of concerns for divorcing parents and couples. Because of this, it is always helpful for divorcing couples to understand how child custody concerns are handled through the family law process during divorce or otherwise.

Generally, child custody concerns are determined based on the guiding principle of what is in the best interests of the child. There are many factors the court considers when evaluating what child custody arrangement would be in the best interests of the child. The court will look to the mental and physical health of the parents; any special needs the child has and the ability of the parents to meet those needs; the wishes of the child; the age and sex of the child; and if there is any abuse.

Additionally, the court will look to religious and cultural considerations to guide their decision as well as the need for a continued and safe home environment; any adjustments to school and community that will be needed; the opportunity for support and interaction with extended family members; and other children whose custody is relevant to the child’s own custody arrangement. The goal of the child custody process is to determine what custody arrangement would be in the child’s best interests and would foster the child’s overall health and well-being.

Understanding how child custody is determined is valuable for divorcing parents because it can help them resolve their understandable custody concerns and work out a child custody arrangement that is best for their child and works for their family. Making sure to focus on what is best for the child is helpful for the family law court and parents to better navigate the sometimes emotional issue of child custody.
