How is child support enforced?

On behalf of Stange Law Firm, PC posted in Child Support on Friday, November 15, 2019.

Child support enforcement is helpful for parents receiving child support and, likewise, parents paying child support to understand. Child support is also important for children receiving it which is why the legal process provides options for child support enforcement to ensure it is paid.

Methods of enforcing child support include withholding federal and state tax refunds; wage garnishment; seizure of property; suspension of an occupational or business license; suspension or revocation of a driver’s license; or denial of a passport. In some circumstances, jail time may also be possible for the failure to pay child support. There are different methods of enforcing child support orders because of the importance of child support for the care of the child receiving the support.

The legal process provides different options to help parents receiving child support enforce their child support order. For parents who are facing challenges paying child support, there are also child support modification options that may be available through the family law process. Based on certain situations, such as a significant change in the circumstances of the parents or the child, a child support modification may be granted. It is essential, however, to follow any existing child support order until any modification is granted by the family law court.

Child support helps to support the needs of children receiving it which is why there are enforcement mechanisms in place to ensure it is paid and received. The family law process also provides resources that can help all parties facing child support concerns.
