- The comparative earning capacity of each spouse
- The standard of living established during the marriage
- The obligations and assets of the marriage, both separate and marital
- The duration of the marriage
- The age, physical and mental condition of the spouse seeking support
- The ability of the supporting spouse to meet both his needs and the needs of the spouse seeking support
The order establishing spousal support must also determine whether the award is modifiable or non-modifiable. If the award is modifiable, the court can modify the award if:
- there’s been a substantial and continuing change in circumstances, or
- one of the spouses has been ordered to pay an amount of child support that’s at least 20% higher or lower than the amount under Indiana’s child support guidelines (Must be more than one year past the original maintenance order)
