Divorce and paternity cases are handled by your local county’s circuit or district court. If the spouses live in different counties, the venue in divorce and paternity cases could be either county.
In some states, the home county of the spouse who files for divorce first will typically be the venue for the trial. If there are children involved, however, the trial may be moved to their county of residence if they have lived in that county for at least 90 days. In paternity cases, some states have a strict “first to file” rule, where whichever parent files first determines the venue. The rules can vary state to state.
