Uncontested dissolution are often confused with collaborative dissolution of marriage. In an uncontested divorce, the parties both want to dissolve the marriage. They also agree on all issues related to their dissolution. Thus, after the procedural requirements are first met, their attorneys are quickly able to put together settlement paperwork to conclude the case.
In a collaborative case, the parties do not agree on all issues out of the gate. In the areas of disagreement, clients work through all issues by sitting down and talking with each other, their attorneys, and other professionals (a divorce coach, a financial neutral, and a child custody professional). Collaborative resolutions can be helpful in cases where both parties want to settle outside of court, but they simply do not agree on all issues.
Mediation is another option some parties might consider as well. Mediation is where the parties sit down with a neutral mediator in the hopes that an agreement can be reached. Mediation can also be helpful in cases where both parties want to settle, but do not have a complete agreement.
The difference between mediation and collaborative is that, in mediation, one party at least (if not both parties) will still need to hire an attorney to file the divorce in court to conclude it. This is the opposite of collaborative resolutions, where the attorneys can (on a limited scope representation) conclude the case in court on an uncontested basis. Additionally, in mediation, the parties do not benefit from the professionals often utilized in collaborative matters.
